We are humbled to announce a $9,000,000 settlement reached at mediation on behalf of a brave little girl who is now five years old. When she was just 18 months old, she fell three stories from a dangerous hotel balcony onto concrete and somehow, she survived.
For more than two years, the hotel and its primary carrier insisted there was only $1,000,000 in available insurance coverage. But the numbers didn’t add up and we refused to accept their story at face value.
What followed was extensive motions practice and a long, uphill legal battle to force transparency. We served countless subpoenas, fought through incomplete and evasive discovery responses, took numerous depositions, reviewed nearly 24,000 pages of documents relevant to the case, engaged focus groups, and brought multiple motions to compel when the defendants failed to produce the documents they were legally required to provide. Several court orders had to be issued just to obtain basic insurance information. Even then, it took persistent follow-up, hearings, and making sure to hold these defendants’ feet to the fire before the truth finally emerged.

And when it did, it was exactly what we suspected all along:
The defendants actually had several additional applicable insurance policies policies that would have remained hidden had we not pushed relentlessly at every stage that ultimately resulted in millions of dollars in additional recovery for our client that she would have missed out on but for our efforts.
Without those additional policies, this little girl and her family would have faced years if not a lifetime of financial strain trying to cover her future medical needs stemming from such a devastating fall.
Because of the persistence, pressure, and meticulous legal work by The Thumbs Up Guys, this child is now fully protected, with the resources she’ll need for future care and the stability her family desperately deserves. They can finally begin moving forward with hope, security, and peace of mind.
